1. Acceptance of terms

By accessing or using My Dream Colors ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. You must be at least 18 years old or the age of majority in your jurisdiction to place an order.

2. Description of service

My Dream Colors creates personalized, AI-generated coloring books for children. You provide your child's name, age, interests, and optionally a photo. Our AI systems generate a custom story, illustrations, and coloring pages tailored to your child. Books are available as digital PDF downloads or as professionally printed and shipped physical books.

3. Ordering and payment

• All prices are listed in US dollars and include applicable taxes unless otherwise stated.
• Payment is processed securely through Stripe. We do not store your payment card information.
• By completing checkout, you authorize us to charge the listed amount and begin production of your personalized book.
• Because each book is custom-made, production begins immediately after payment. This is important for understanding our Refund Policy.

4. Product tiers

• Digital ($14.99): A downloadable PDF coloring book formatted for standard US Letter (8.5" × 11") home printing.
• Standard ($29.99): A professionally printed 8.5" × 11" coloring book, shipped to your address. Includes free shipping within the US.
• Premium ($39.99): A premium-quality printed coloring book with upgraded binding and paper, shipped to your address. Includes free shipping within the US.

5. User responsibilities

• You are responsible for providing accurate information including your child's name, age, and a valid email address.
• You must have legal authority to upload any photos and provide any personal information about the child featured in the book.
• You agree not to upload content that is illegal, harmful, abusive, or inappropriate for children.
• You are responsible for reviewing and approving the character preview and page previews before checkout. Once approved and paid, the book enters production.
• You are responsible for providing an accurate and complete shipping address for printed orders.

6. Content and AI generation

• Books are generated using artificial intelligence. While we strive for high quality, AI-generated content may occasionally contain imperfections, unexpected elements, or variations from what you might expect.
• We provide a character preview and page previews before checkout so you can review the output. This is your opportunity to request changes (within the allowed number of re-rolls) or decide not to proceed.
• We reserve the right to decline or cancel orders containing content we determine to be inappropriate, unsafe, or in violation of these terms.
• The stories, illustrations, and coloring pages generated for your book are unique to your order. You may use your book for personal, non-commercial purposes (printing at home, gifting, etc.).

7. Intellectual property

• The My Dream Colors brand, website design, and underlying technology are our intellectual property.
• You retain ownership of any photos you upload. By uploading, you grant us a limited license to use the photo solely for generating your book and providing customer support.
• The generated coloring book content (story text, illustrations, page layouts) is licensed to you for personal use. You may not resell, redistribute, or commercially exploit the generated content.

8. Shipping and delivery

• Digital orders: Delivered via download link on the order status page and by email. Available immediately after generation is complete.
• Printed orders: Printed and shipped by our print partner (Lulu). Typical production time is 3-5 business days, with shipping times varying by location (usually 5-10 business days within the US).
• We will provide tracking information via email and on your order status page once your book ships.
• We are not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control.
• If your package is lost or damaged in transit, contact us and we will work with you to resolve the issue.

9. Refunds and cancellations

Because each book is custom-made and personalized, our refund policy has specific terms depending on the product type and order status. Please review our full Refund Policy for details.

In summary: digital orders may be refunded before the PDF is generated. Printed orders may be refunded before the book is submitted to the printer. Once a printed book has shipped, refunds are not available. We will replace books that arrive damaged or with significant print defects.

10. Limitation of liability

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, My Dream Colors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to dissatisfaction with AI-generated content, shipping delays, or printing quality variations.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the specific order in question.

11. Prohibited uses

You may not use the Service to:

• Upload photos of children without the consent of their parent or legal guardian.
• Generate content that is sexually explicit, violent, hateful, or otherwise harmful to children.
• Attempt to reverse-engineer, exploit, or interfere with our AI systems or infrastructure.
• Use automated tools (bots, scrapers) to access the Service.
• Resell or commercially redistribute generated books or content.

12. Termination

We reserve the right to refuse service, cancel orders, or terminate access to the Service at our discretion, particularly in cases of terms violations, suspected fraud, or inappropriate content. If we cancel an order that has been paid but not yet fulfilled, we will issue a full refund.

13. Changes to terms

We may update these terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the updated terms.

14. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.
